Creditor Negotiations
Once the bankruptcy application is on file, you gain instant relief from stressful phone calls and letters from your creditors and their collection agencies. Unsecured creditors (such as credit card companies, department stores, etc.) must immediately stop contacting you for repayment. Instead, they must now deal with the trustee until the court has finished with your case.
It does take up to 5 business days for your trustee to notify all of your creditors, and some of them may have turned over your file to collection agencies. All of this contact should stop shortly after your bankruptcy papers have been filed. If it does not, inform the collector of your circumstances and pass along your trustee’s contact information. You can also report this contact directly to your bankruptcy trustee.
